Role and Responsibility of the Expert Witness - Engineer

An engineer expert witness (EEW) is an individual who has extensive knowledge and expertise in the field of engineering. Their role is to assist the judicial system, including judges, juries, and lawyers, in understanding the technical aspects of a case. This may include explaining the application of scientific principles to specific situations, particularly in relation to laws and regulations. The EEW may provide testimony on a wide range of topics such as traffic accident reconstruction, speed measuring devices, vehicle equipment, and traffic control devices. It is important to note that all our conclusions are derived from evidence-based data and not from unreliable or unscientific sources.

By Definition

Vehicular Manslaughter is defined as causing the unlawful death of another human being using a vehicle. It can be a felony or misdemeanor.

Police Investigation Methods - Vehicular Manslaughter

In some states law enforcement are using the downloaded data from the vehicle’s black box / event data recorder (EDR). As a matter of fact some department’s are uses the EDR as a stand alone accident investigator tool, which is somewhat questionable. Once the vehicle is impounded (in police custody) the auto black box data is downloaded which may require a warrant or not (warrant-less issue). This is determined by a state by state and/or as well as a Fyre (standard) or Daubert (standard) hearing.  Other police departments use different methods to determine the proximate of the accident.

California Vehicular Manslaughter Expert

Has several different degrees of recklessness and/or intoxication levels, but in general the State must prove that the driver committed some unlawful act with a motor vehicle resulted in a fatal accident.

New York Vehicular Manslaughter Expert 

Vehicular Manslaughter first degree. (Updated for 2013)

S1915-2013: Increases the penalty for vehicular manslaughter to a class A-I felony; repealer. 

125.13 - A person is guilty of vehicular manslaughter in the first degree when he or she commits the crime of vehicular manslaughter in the second degree as defined in section 125.12 . Vehicular Manslaughter second degree. * 125.12 - A person is guilty of vehicular manslaughter in the second degree when he or she causes the death of another person.

New Jersey Vehicular Manslaughter Expert

Driving in a reckless manner that caused the death of another human being. In 2012 or thereabout, NJ amended the term reckless to included using a cell phone (Bill S1616) as well as sleeping while driving.

Connecticut Vehicular Manslaughter Expert

There are several offenses the police can consider when a person accidentally causes the death of another person through the operation of a motor vehicle. They include manslaughter in the first degree (CGS § 53a-55), manslaughter in the second degree (CGS § 53a-56), manslaughter in the second degree with a motor vehicle (CGS § 53a-56b), misconduct with a motor vehicle (CGS § 53a-57), and negligent homicide with a motor vehicle (CGS § 14-222a).

Nevada Vehicular Manslaughter Expert

NRS 484B.657 Vehicular manslaughter; penalty; additional penalty for violation committed in work zone. 1. A person who, while driving or in actual physical control of any vehicle, proximately causes the death of another person through an act or omission that constitutes simple negligence is guilty of vehicular manslaughter and shall be punished for a misdemeanor. 2. A person who commits an offense of vehicular manslaughter may be subject to the additional penalty set forth in NRS 484B.130. 3. Upon the conviction of a person for a violation of the provisions of subsection 1, the court shall notify the Department of the conviction. 4. Upon receipt of notification from a court pursuant to subsection 3, the Department shall cause an entry of the conviction to be made upon the driving record of the person so convicted. NRS 484.3775 Vehicular manslaughter; additional penalty for violation committed in work zone; notification to Department of conviction by court; recordation of conviction upon driving record of violator.
